Update on lawsuit related to problems in administrative screening process for admission to nursery school

I haven't had time to write about the case on the English language blog I started after the Supreme Court handed down its decision, that blog being at http://case-study-on-judiciary-japan.blogspot.jp/, however, I have placed almost all of the relevant filings and findings for the entire case through all levels of the court system and appeals on a Japanese language blog with brief commentary, that blog being at http://blog.goo.ne.jp/darren918jp

I also interviewed with a law professor whose books and papers helped me pursue the case, and I will post a translation of the first paper that he has written on the case--which should be released this month--as soon as circumstances permit.

There has been a flurry of activity related to this issue in Japan recently, with claims in another case at the district court level also being questionably refused in a city in Okinawa. There is an article in the Mainichi Shimbun from about a year ago on the seriousness of the issue in Tokyo, where it was an issue that some candidates addressed specifically in the recent mayoral election there. The title of the original Japanese article is The Childcare Uprising. Groups of up to 30 parents have been filing group petitions objecting to spurious administrative procedures in relation to the admissions process, etc. Tokyo, in particular, has a critical shortage of nursery school capacity at present, whereas it is a right of parents and children to attend nursery school. What we have is a case of passing legislation and not funding what the legislation mandates.

The Abe administration has set out to implement preliminary measures toward bringing down the number of children waitlisted for childcare to zero by fiscal 2017, but doubts about the prospects of the measures' success remain.

In municipalities across the nation, the application process for spots at authorized childcare facilities starting next spring kicked off this month. In Tokyo's Suginami Ward, which is set to begin accepting applications on Nov. 13, about 100 parents have come into the ward office every day to consult with staff in the childcare division.

After some 1,500 children were denied entry to authorized childcare facilities in Suginami in April this year, parents lodged a formal objection under the Administrative Appeal Act, an act that became known as "the childcare uprising." The uproar spilled over into other parts of Tokyo, as well as the city of Saitama. But the waiting lists have yet to disappear.

The number of children waitlisted for childcare services across the country stood at 22,741 as of April 2013. However, the actual figure is estimated to be a digit greater, due to families who give up on their slim chances of getting into authorized childcare facilities and don't bother to apply for a spot.

Municipalities have repeatedly seen a phenomenon in which they increase the number of spots for childcare in the short term, and the number of waitlisted children actually increases because those who didn't apply for spots in other years submit applications, counting on having a better chance.

The current lack of childcare services is a consequence of having allocated a mere 4 percent of social welfare spending on child rearing. According to the social welfare and tax reforms passed last year, the consumption tax, which had heretofore been funneled toward geriatric health care, nursing care and pensions, will also be used toward child rearing support.

Copy of Privacy Act/FOIA request to CIA

In case anyone was wondering what type of request the CIA denied, it was fairly standard, using phrasing copied from the corresponding CIA webpage http://www.foia.cia.gov/privacy_request, as follows, for the request, along with a brief description.

Note that another aspect of the denial of the PA request that is even more basic than the creation of a secret court system is that the CIA has, by denying my request on national security grounds (the need to protect CIA "sources and methods"), is to attempt to cover up violations of legal statutes that govern the conduct of the CIA and its officers, in effect claiming that their "sources and methods"--which I've subjected to a fair amount of public scrutiny here, take priority over the legal statutes governing the CIA and the rights of American citizens living abroad.

That puts the spot light on what these so-called "sources and methods" are in the first place, and secondly on the need to answer the question as to whether or not the "sources and method" at issue were appropriate and legal in the specific context. That context is, of course, the context of a private American citizen living in an allied country that is a constitutional monarchy with a free-market system and the world's third largest economy.

The only possible recourse to "sources and methods" would pertain to those employed to protect me from organized crime groups operating in Japan, but that could hardly translate into a justification for the CIA violating my rights and breaking the law in the process, which they did because they were trying to run me out of town so that they could collaborate with the yakuza like in the days prior to the enactment of the strengthened anti-organized crime laws in  2001 called the Organized Crime Exclusion Ordinances: https://en.wikipedia.org/wiki/Yakuza_exclusion_ordinances

Even the enactment of those ordinances didn't stop the CIA from harassing me, however, so that just reinforces the degree to which the CIA demonstrates a mentality of being above the law.

CIA's reply to Privacy Act request for Information held by CIA on me

Having been put off by the DOJ initially for almost a year regarding a case with respect to which I assume the claim is that it wasn't investigated, after filing a request based on the Privacy Act, I received the following official correspondence from the above mentioned agencies.

Apparently the sole means of possibly bring the CIA to account by having their actions subject to scrutiny is through the judicial system, by an in camera examination of the documents by a judge in a court of law where a formal complaint has been filed against the CIA. 

That is to say, it is impossible to obtain or even receive acknowledgment from the CIA that they have documents on you that they shouldn't have because they very fact that they might (i.e., read "do, in fact have such documents") is classified. These would seem to be clear signs that a dysfunctional US government is resorting to use of its espionage services in order to pursue illegitimate interests, even if it means taking illegal actions and against individual citizens living abroad in a country that is a part of some illegitimate espionage operation targeting civil society in national with which the US in on good terms.

Note that the crux of the response lies in the following passage:

With respect to responsive records that would reveal a classified connection to the CIA, in accordance with section 3.6(a) of Executive Order 13526, as amended, the CIA can neither confirm nor deny the existence or nonexistence of records responsive to your request. The fact of the existence or nonexistence of requested records is currently and properly classified and relates to intelligence sources and methods information that is protected from disclosure by section 6 of the Central Intelligence Agency Act of 1949, as amended, and section 102A(i)(l) of the National Security Act of 1947, as amended. Therefore, you may consider this portion of the response a denial of your request pursuant to FOIA exemptions (b)(l) and (b)(3), and PA exemptions G)(l) and (k)(l).

The cited exceptions are:
(j)(l) exempts from disclosure certain information maintained by the Central Intelligence
Agency;
(k)(l) exempts from disclosure information properly classified, pursuant to an Executive Order;

One can see the inherent problems with such a loophole, as it provides the CIA a screen from being subject to public scrutiny, going so far as to deny access to individual America citizens abroad with respect to whom the CIA has no right to investigate (unless they are suspected of "international terrorism").

There are other ramifications of such desperate legal contortions, and I can think of at least two at present: firstly, the system is akin to the establishment of something like the so-called Star Chambers of 15-16th century England, in which absolutely no exposure of the malfeasance of high ranking official could be brought about publically through the judicial process https://en.wikipedia.org/wiki/Star_chamber; and secondly, the administration of President Barack Obama (he signed "Executive order 13526" in December 2009).

Facebook is now crawling with CIA and MI6 officers in Kyoto and Kansai...

Some of you will have read an earlier post in which I mention that Brian Schultz 'de-friended' me on Facebook apparently in order to conceal the identities of all the intelligence officers in attendance at a little riverside gathering hosted by Justin Giffin. Well, the CIA and MI6 apparently decided to change tact sometime in the not-too-distant past (I can't monitor these people all the time), and now they are all sort of hiding in the open there, literally a hundred or more individuals. 

The implications will not be readily apparent, but let me briefly say that with respect to civil society and the availability of opportunities for normal Westerners in Japan (not to mention Japanese citizens), the effect (if not strategy) of the intelligence agencies is to colonize civil society (e.g., monopolize teaching jobs at universities, etc.) in a manner such as to exclude non-intelligence officer foreigners and network with Japanese people in a manner that causes even graver damage to civil society in Japan. I've already touched on the exclusionary aspects of their sociopathic networking endeavors.

What is important to bear in mind is that all of these individuals are receiving a salary of $US 100,000 or more on top of what they earn locally, so they are not really here as normal people living on a normal budget; American and British and Irish and Canadian tax payers are paying them substantial salaries to basically serve as agents infiltrating civil society overseas in a manner that is 100% incompatible with Western values of free-market economics, the pursuit of happiness, open society, etc. They are part of a nexus of a neo-feudalistic social network that poses a serious problem that remains hidden. Naturally, part of my aim is to expose this pernicious activity of the Western intelligence agencies in Kyoto. No doubt it is a pattern that could be found in many other places in a form tailored to the specific environment.

Aside from the fact that you can view these individuals on Facebook--and note that the respective governments of England, Ireland, Canada, the USA, etc. do not remove these individuals even after I expose them is in need of further examination--later.

Those I've exposed heretofore are most certainly intelligence officers, others just suspect based on circumstantial evidence and degree of association. I feel comfortable mentioning their names in the context of examining the networks of people associated with those individuals with respect to whom there is no question that they are intelligence officers. 

If nothing else, Mr. Maclaren, for example, who studied at Harvard, is networked with at least five individuals that I can assert with a high degree of certainty are CIA officers, including one or two that lived in my old apartment building. A couple of them used to pop up quite frequently and apparently were on my security detail, but they have dropped out of sight in the past year or so. And that's in addition to at least three MI6 (presuming that Irish are MI6) officers. Mr. Mclaren might be Canadian, in which case, if he were an intelligence officer, he would belong to the Canadian Security Intelligence Agency:

I could name others from these pages, but I'll save that for another time, as I have to leave this post short and get some work done. Suffice it to say that if you take a cross section of the people on these pages with those of people on a few others pages I'll post soon, the number of people involved is astonishingly large. Although a few of the individuals are engaged in socially beneficial activities, the majority are sort of nothing more than entities whose activities could be seen to be neo-colonial and aimed at promoting the interest of Western corporations. Feudalism and neo-corporatism are interrelated societal configurations, historically.

In closing, there are two other trends that I've noticed in conjunction with the "hide in the open on social media" phenomena: (1) the agencies have been concentrating on sending retirees my way and withdrawing the younger officers, hoping to protect their cover, I suppose, and perhaps hoping to shield themselves by sending retirees--who aren't technically active intelligence officers; and (2) an uptick in the number of conspicuous homosexuals (elderly lesbian couples, etc.) on the streets and in the cafe.
