First-hand experience of Institutional Racism in Japan's system for the administration of justice - Prosecutor's decision in proven criminal case

In my last post about this case, I explained how the local public prosecutor's office in Kyoto  had refused to accept the criminal complaint I had filed in this case, which was for white collar crime activity entailing a maximum penalty of 2-5 years incarceration with hard labor against 5 individuals and one corporation who acted in a conspiracy that targeted me, personally, as well as my children. The culprits are believed to be connected to local law enforcement as well as intelligence agencies (the Kyoto police, the CIA and the Japanese Public Security intelligence Agency) and/or organized crime, as described in the complaint, but the prosecutor appears to have categorically refused to investigate those claims. 

After I was compelled to notify the Supreme Public Prosecutor's Office in Tokyo, the local prosecutor's office had to relent and accept the complaint, but the clerk (an individual named Kishizawa who has evinced questionable behavior) I had been dealing with refused to inform me of the fact, despite the fact that he knew I wanted to receive telephone notification and a stamp on my copy of the complaint. 

The accepted the complaint on a Friday, November 1st, before a 3-day holiday weekend in Japan. Then I called on the 5th to check on the status of the case and was informed by Kishizawa that the case had been accepted by the prosecutor on the 1st, but he claimed he hadn't promised to telephone me about that. Moreover, the prosecutor made his decision not to indict the culprits the following day, the 6th, after only 2 working days between the day he accepted the complaint and the day he took the decision. The prosecutor has an obligation to investigate the alleged crime, but it is difficult to imagine how he could have even contacted all 5 of the individuals who committed the crimes, as admitted by the prosecutor in their reason for declining to indict.

The reason was not even provided with the notice, so I had to file another request to learn that. My request and the response are shown below, but first, an excerpt of the Japanese Penal Code that explains the decision, which recognizes that the crimes were committed, but declines to indict due to circumstances.     

 第二章 公訴Chapter II Prosecution
第二百四十七条 公訴は、検察官がこれを行う。Article 247 Prosecution shall be instituted by a public prosecutor.
第二百四十八条 犯人の性格、年齢及び境遇、犯罪の軽重及び情状並びに犯罪後の情況により訴追を必要としないときは、公訴を提起しないことができる。Article 248 Where prosecution is deemed unnecessary owing to the character, age, environment, gravity of the offense, circumstances or situation after the offense, prosecution need not be instituted.

The translation of Article 248 is actually slightly lacking for want of the subject of the "character" and age", as it does of course represent the individual(s) who committed the crimes, which are implicitly acknowledged by the prosecutor in this reason for foregoing indictment. There are other reasons, such as a lack of evidence, no crime committed, etc.

In this particular case, however, there is no reasonable basis for not indicting the culprits, so I have to go through more time consuming tedious paperwork to file a protest against the decision of the prosecutor, which get heard and examined by a panel of citizens.

Who was Japanese war criminal Nobusuke Kishi? (i.e., the maternal grandfather of the current prime minister of Japan...)

However, you might call him “CIA’s favorite Japanese Nazi”. That is not to brandish the term “Nazi” around in an uneducated manner (see below) or a cheap shot personal attack on the war criminal who was referred to as the “ghoul of Showa” (Showa was the era name) in Japan. Still, such a rephrasing basically just begs the question as to who the CIA is, and why call the him a Nazi instead of a Japanese imperialist fascist, for example. We don’t, for example, call Mussolini a Nazi, right? The Nazis were just the most archetypal representation of this group of fascist monsters, each requiring particular research into the specific circumstances of their appearance and distinguishing characteristics.

The CIA had a habit of recruiting war criminals into high level positions of administrations they set up after WWII, nominally to fight communism. The CIA placed a former Nazi officer in charge of the intelligence agency in West Germany (https://en.wikipedia.org/wiki/Reinhard_Gehlen, ). Gehlen, in turn, recruited other war criminals, including SS officers like Emil Augsburg, etc. (https://ips-dc.org/the_cias_worst-kept_secret_newly_declassified_files_confirm_united_states_collaboration_with_nazis/).  And they tried to hide other war criminals to protect their anti-communist racket (https://www.cbsnews.com/news/documents-cia-hid-nazis-locations/).

So, this Japanese ghoul of Showa named Nobusuke Kishi was a Class A war criminal who would have been executed, in all probability, had the CIA not made him an offer he literally couldn’t refused.

Why was he called the ghoul of Showa? Well, he was the highest civilian authority in the puppet country called Manchukoku (https://en.wikipedia.org/wiki/Nobusuke_Kishi#/media/File:Manchukuo_map_1939.svg) set up in Manchuria by the Japan imperial army. Manchukoku is where the infamous Unit 731 (https://en.wikipedia.org/wiki/Unit_731), a covert biological and chemical warfare facility that conducted human experimentation was located. In terms of a direct comparison to Nazis, Nobusuke Kishi was basically the equivalent of the top civilian Nazi in Poland, an individual named Hans Frank: https://en.wikipedia.org/wiki/Hans_Frank. Frank was sentenced to death for war crimes and crimes against humanity.

Kishi formed close ties with Nixon as prime minister.

Who is Takuya Hirai (平井卓也)? Well, he's a right-wing cabinet minister in the CIA's Abe regime, but stay tuned for conceptual framework

Hirai is the LDP front man fronting for the government side in the promotion of the IT front companies (CIA et al.) they use to infiltrate and present a semblance of economic growth, progress and prosperity both as a ruse for electoral propaganda, and to provide jobs as covert operatives for children of the politically connected in areas like Kyoto, which has immense cultural and political import, in addition to being a very nice place to live. https://en.wikipedia.org/wiki/Takuya_Hirai

When I say "right-wing", in this case it refers to the ultra-nationalist neo-fascist wanna-be Shinto theocrats in the Nippon Kaigi. This photo (https://www.facebook.com/hiratakuchan/photos/a.934863833388702/1171367019738381/?type=3&theater) shows Hirai visiting the Yasukuni Jinja, which is probably the most controversial religious institution in the country due to its having enshrined the spirits of executed war criminal in the 1970s by a right-wing Shinto priest, after which the emperor Showa withdrew the Imperial family's support for the shrine. No time for scholarly details, but this is in line with the CIA's pushing the efforts of LDP political party they funded and otherwise backed to revise the pacifist clause (Article 9) of the post-WWII US-drafted Constitution of Japan.


Here you can see Mr. Hirai on his official FB page (https://www.facebook.com/hiratakuchan/) with the CIA's IoT front company front man in Kyoto, Kristopher Tate. That post is from June of this year, and I left a comment reading, 
"Remove all fraudulent CIA et al. IT front companies from Kyoto!"
That comment has since been removed (from the post?)... which would appear to be flagrant censorship by a corrupt (officially sanctioned) government official. It's hard to make out the actually scenario on FB, but this is what the post originally looked like, complete with the text "Pitch to the Minister", (#HIRAIPitch).



Actually, Mr. Hirai, seems to have removed the above post from his FB page in the past 18 hours, since I posted his name in the preceding post about suspected Taiwanese intelligence operative Ho Chi Chan (aka Doris Chang)... but I had archived the thread...

Who is 張 鶴祺? (English: Ho Chi Chang (aka Doris Chang))

She is another suspected female intelligence operative from Taiwan (e.g.: https://kyoto-inside-out.blogspot.com/2019/07/who-is-tzu-yu-huang-from-taipei-taiwan.html). That is to say, another link in the Taiwan connection to the right-wing LDP politicos (including Takuya Hirai: Minister in Charge of Science and Technology Policy: https://en.wikipedia.org/wiki/Takuya_Hirai) working for the CIA (i.e., Kristopher Tate; more in forthcoming post on Taiwan Connection), etc.

As has been addressed with respect to the right-wing CIA operatives (i.e., Tate, etc.) that have been infiltrated into Kyoto and attempt to implement various types of linkage (including commercial) between right-wing Japanese politicians and the anti-China right-wing politicians in Taiwan, this suspected intelligence operative is presumed to represent another link in the chain.

In 2016 Chan married a Japanese named Ryo Matsuoka, who is suspected to be an intelligence operative in the Japanese Public Security Intelligence Agency or the Taiwan intelligence agency (recruited by Chan?). America's unholy trinity of Evangelical Fascists in the White House: Mike Pompeo, Mike Pence, Donaldo Trump

Naturally, since the CIA has long overtaken the US Department of State, it would have been difficult for me to make a report of the legal troubles I'm having with the fascist police and government bureaucrats here in Kyoto, whom are likely being coordinated by operative in the Japanese Public Security intelligence Agency.
They are all basically Nazis that espouse one brand of right-wing religious ideology or another, and violate the Constitution of their respective country at will, by covertly co-opting the judiciary.

Looks like I may have to bypass the US Department of State and report directly to the UN Human Rights Commission first.

So, the White is occupied by the above-mentioned trinity of Evangelical Nazis, as well as a couple of side-kick Zionist Ashkenazi-Nazis to boot in the form of Stephen Miller and Jared Kushner. And that is the team that is promoting right-wing fascist religious movements and fomenting strife around the planet, including in India and Japan, with Shinzo Abe's grandfather (Nobusuke Kishi: https://en.wikipedia.org/wiki/Nobusuke_Kishi) having been a bonafide Japanese fascist known as the "ghoul of Showa" who was facing execution through trial as a war criminal after WWII before he was recruited by the CIA to set up the LDP, the CIA's political front party ever since... He later became buddies with Nixon, if that tells you anything. So Shinzo Abe is naturally towing the CIA line to eliminate the pacifist clause (Article 9) in the US-drafted Constitution of Japan.

The case of Ghosn and institutional racism in the Japanese justice system

While I do not have any sympathy for white collar criminals, and it seems that Ghosn is probably guilty of some sort of financial crime, the treatment he has received at the hands of the Japanese authorities doesn't seem to meet the minimum requirements as equal before the law.

Next stop, police, again, and then I will have to file a complaint against them for refusing to perform their duty, most likely.

Running Battle with Institutional Racism in the Japanese Justice System - The Public Prosecutors Office in Kyoto

This notice arrived today stating that the prosecutor has decided not to indict the people against whom I filed a criminal complaint, giving no reason for the refusal.

I take this as a clear case of institutional racism, which will become clear after all of the details of the case becomes public, but for now, to avoid interstitial conflagrations, I've covered the names of the suspects.

Note that the crimes have been admitted to me personally, and are proven being a shadow of a doubt by public documents, so the refusal by the Public Prosecutors Office is purely politically motivated.

In particular, the defendants included people that are suspected to be intelligence operatives, so this amounts to an attempted cover, and obstruction of justice.

The case itself involves a conspiracy among 5 named individual suspects and 1 corporation, and potentially at least 3 others and 1 more corporation, including public servants (in their actual day job, aside from being intelligence operatives/etc.) who should be indicted after further evidence is uncovered during the investigation. The penalty for the crimes is up to 2 years with hard labor. The prosecutor didn't even investigate the crimes, apparently, since he decided not to indict a mere 5 days after accepting the complaint. I doubt that he even called the suspects in to interrogated, but, as I said, the crimes are indisputably proven by documents of public record, which I will eventually post on this blog.

Office of the Public Prosecutor finally accepted a criminal complaint I filed (unrelated to the complaint made to the police)

Update: After writing this post earlier I called the Public Prosecutors Office in Kyoto and learned that the case has been formally accepted as of November 1. Now there is an investigative period after which the prosecutor makes a determination whether to indict or not.

So I will leave the following up for general reference, as it has been a very trying time waiting for the process to be engaged, and there are legal issues that may be of general interest to the public.

There are legal questions related to the investigative and indictment process as well, but I will wait until they come into play specifically.

This is the response I received from the Supreme Public Prosecutors Office in Tokyo requesting that they contact the Kyoto regional Public Prosecutors Office to have them timely accept the complaint. The complaint has yet to be accepted, though it was filed in August, and this notice was received a couple of weeks ago. And there are other criminal complaints to follow, which I've already discussed with the local prosecutors office. 

Once they accept a complaint, they have an obligation to investigate, so there are various possible reasons for their delay. They can even formally refuse to accept a complaint if they have legal grounds for doing so, but in this case, the content is proven beyond reasonable doubt by documentary evidence already submitted, so the delay is somewhat unusual according to at least one attorney I've consulted. And refusing to accept a valid complaint is a crime in and of itself, one of which several counts have been committed against me by the police, etc., in violation of Article 193 of the Penal Code of Japan: Abuse of Power.


It bears noting that due to the criminal collaboration of CIA operatives I don't easily have recourse to complaining to the US Consulate in Osaka or Embassy in Tokyo, though eventually I will have to. I have contacted the High Commissioner on Human Rights with the UN in Switzerland in relation to the ongoing and multifaceted legal imbroglios that have swept up my children by the racist Japanese judiciary, and was told to send documents, etc., but don't have time to translate them, etc. Since neither the US nor Japan has ratified the special protocols of the UN Human Rights Treaty, they can't be held accountable. Some Japanese in international marriages, being indirectly encouraged by their corrupt government, think it is OK to kidnap children and keep them from their parents (look up the Hague Convention). I had to consult another attorney when my attorney suddenly resigned after I consulted the Kyoto Bar Association in regard to his performance.

So, I need to retain a new attorney...


Meanwhile, it's like a running battle here with the various intelligence agencies, as well as corrupt local law enforcement and justice system that is rife with institutional racism here in Japan, aside from the bureaucratic machinations at play. And the Starbucks and other stores that bear the name of an American franchise (Starbucks and Tullys in Japan are owned by Japanese companies).


And there the scores of young women trying to make a scene in conjunction with operators of local night life establishment, or so it would seem. 


One woman I met not long ago would go to work at the cafe after leaving her 8 hour shift in her corporate office, and has told me that she is married and her husband is in the USA taking an MBA. She's a nice girl, very friendly and quite pretty, but her story is a little suspect, a that is a not infrequent occurrence with women I meet there. In this case, her story has components that overlap with another woman I've described on this blog (an attorney) whose husband also went abroad while she stayed in Japan. She is suspected of working for the CIA, MI6 or Japanese Public Security Intelligence Agency, so the latest girl could represent a pattern. Is a corporate career reason enough for a supposedly recently married couple (@30 years of age) would decide to live apart from each other? American/British colleges operate MBA programs here in Japan, but I digress...


I can't go into the details of the criminal complaint to which this notice refers until the trial goes public.
